 Reply of the President of Germany Dr. Joachim Gauck on a parliamentary question by Latchezar Toshev (Bulgaria) on the need for elimination of legal prescription periods for the crimes committed by communist regimes in Europe.

Г-н Президент, Вие сте един от хората, които са напълно наясно с общественото разделение в Централна и Източна Европа, което е резултат от липсата  на справедливост по отношение на престъпленията извършени от бившите комунистически режими. Много от  отговорните за тези престъпления, никога не бяха изправени пред съда, заради изтичане на периода на давност. Като президент на Германия, готов ли сте да инициирате законателни промени на европейско ниво, които да премахнат давностните срокове прикриващи разследването  и наказването  на лицата от тези режими, извършили въпросните престъпления?

Сега, на въпроса, който е интересен за много посткомунистически страни:
Много от злодеянията на комунистическите господари са покрити с давност, това не може да се отрече. Но, може би трябва да обмислите, че има също възможност да се говори за вина и отговорност извън съдилищата.
Големият немски философ Карл Ясперс показа след войната на немците, че говорим за вината в различни измерения: наказателна, морална, политическа и религиозна отговорност. За всяко измерение има различна инстанция за третиране на вината.  Съдът е само една от инстанциите и давностните срокове, които имаме сега са също едно либерално законово право; което не винаги бих приел (бих поставил в диспозиция).

Това обаче не означава, че би трябвало да е невъзможно да се говори за политическа отговорност с имена и адреси и също вината да се нарича „вина”. Инстанцията, която в такава рамка нарича виновните виновни би била публичното обсъждане, това са нашите учени, нашите медии, гражданският дискурс. Трябва да е възможно диктаторът да бъде наречен „диктатор”, даже и когато не е вече възможно да го изправим пред съда. 
И това е възможно ако възприемем една разширена концепция за вина.
Би било вероятно по-важно, в един публичен дебат да делегитимираме хората, които сами вече са се делегитимирали. Това би могло да спомогне за намаляване на напрежението в юридическите дебати.

Nun zu einer Frage, die besonders für viele postkommunistische Länder interessant ist: Viele der Untaten der kommunistischen Herrscher sind verjährt, das lässt sich nicht leugnen. Doch vielleicht müssen Sie darüber nachdenken, dass es auch außerhalb von Gerichten eine Möglichkeit gibt, über Schuld und Verantwortung zu sprechen.
Der große deutsche Philosoph Karl Jaspers hat den Deutschen nach dem Krieg einmal dargestellt, dass wir in verschiedenen Dimensionen über Schuld sprechen: strafrechtliche, moralische, politische und religiöse Verantwortung. In jeder Dimension gibt es eine andere Instanz, Schuld zu bearbeiten. Das Gericht ist nur eine Instanz und Verjährungsfristen, die wir nun einmal haben, sind auch ein liberales Rechtsgut; die würde ich nicht jederzeit zur Disposition stellen.
Das heißt aber nicht, dass es unmöglich sein muss, über politische Verantwortung mit Namen und Adresse zu sprechen und Schuld auch „Schuld“ zu nennen. Die Instanz, die in einem solchen Rahmen Schuldige schuldig nennt, das wäre der öffentliche Diskurs, das sind unsere Wissenschaftler, unsere Medien, der Bürgerdiskurs. Es muss doch möglich sein, einen Diktator „Diktator“ zu nennen, auch wenn es nicht mehr möglich ist, ihn vor Gericht zu stellen. Und es ist möglich, wenn man sich einen erweiterten Schuldbegriff aneignet.
Das wäre vielleicht wichtiger, dass wir in einer öffentlichen Debatte die Menschen delegitimieren, die sich selber delegitimiert haben. Das könnte man zur Entspannung der rechtlichen Debatte vielleicht dazu lernen.

TOSHEV (Bulgaria) Mr President, you are well aware of the social divisions in central and eastern Europe that are a result of the lack of justice in addressing crimes committed by former communist regimes. Many of those who are responsible for those crimes were never brought before the courts because of the prescription periods. As the President of Germany, are you committed to legislating at European level to eliminate the prescription periods covering the investigation and prosecution of the people from those regimes who perpetrated these crimes?

Mr GAUCK:
It is an interesting question about many of the post-communist countries. It is true that many of the crimes that were committed are statute-barred. Perhaps I could share a thought with you, and perhaps you would like to mull it over. There is a possibility to talk about responsibility and guilt and to do so outside of a court context. Karl Jaspers, the German philosopher, talked about this possibility, and about guilt and responsibility, in post-war Germany. We can talk about this in different dimensions – in terms of criminal law, moral responsibility, religious responsibility and so forth. In each of these dimensions there are different bodies to which we can turn, and the court is one such possibility.
There is a statute of limitations and it forms part of our community of liberal values, and I would not question that. Nevertheless, it should be possible for us to talk about political responsibilities, to name and shame and to talk about the responsibilities incurred. There are bodies that can be entrusted with this task, and public discourse is one forum where these matters can be discussed. Civil society can therefore be brought into the discussion. Surely it must be possible to talk about what happened and who did what even if you cannot bring these matters before a court. I would say that it is possible to discuss these matters of responsibility. It is important for us to have a public debate. It is important for people not to be disfranchised or to take themselves out of this debate. Let us have this debate.
I think that it would be a learning process.

M. TOSHEV (Bulgarie) Vous comptez, Monsieur le Président, parmi ceux qui ont une conscience vive de la division des sociétés d’Europe centrale et orientale faute que la justice ait été rendue s’agissant des crimes du communisme en raison des règles de prescription.
Êtes-vous prêt à vous engager afin que des mesures législatives soient prises sur un plan européen pour mettre un terme aux périodes de prescription en la matière ?

M. LE PRÉSIDENT DE L’ALLEMAGNE
 
Même les habitants de l’ancien bloc de l’Est – Pologne, ex-Tchécoslovaquie, Roumanie, Bulgarie etc. – qui ont été forcés à apprendre la langue russe ont finalement choisi d’user de l’anglais tant cette langue est commune dans bien des domaines. Je n’y ai pas fait référence pour demander aux Britanniques d’être plus proches de l’Europe mais pour des raisons pragmatiques.
Les crimes du communisme sont en effet prescrits, mais la définition de la culpabilité ne se limite pas au seul domaine juridique. Le grand philosophe allemand Karl Jaspers a rappelé que cette notion peut se décliner sur plusieurs modes : juridique, moral, religieux, etc.
La prescription, quant à elle, constitue un important acquis juridique qui ne saurait être remis en cause mais cela ne signifie pas que la responsabilité politique ne puisse être formulée publiquement, médiatiquement et civiquement : un dictateur reste un dictateur même s’il n’est plus possible de le traduire en justice. Il importe donc de nourrir un débat public.
